These General Terms and Conditions of Sale (hereinafter the "GTC") govern the relationship between CHC COMPANY SRL, located at rue de la Fontaine Maqué 37, 1440 Braine-le-Château, Belgium (hereinafter the "company" or "CHC Co."), registered under number BE0665.990.419, and any natural person (hereinafter the "Customer") wishing to make a purchase on our website www.mrcelestin.com (hereinafter the "Website"). These GTC do not apply to relationships between the company and its resellers, whether natural or legal persons.
1. Purpose
These GTC define the terms and conditions of distance selling between CHC Co. and the Customer, from order placement to delivery, including payment and the right of withdrawal.
2. Products and Availability
The products available on the Website are described with care and the photographs provided are as faithful as possible. In the event of a stock shortage or temporary unavailability of a product, CHC Co. will inform the Customer as soon as possible and will offer either a refund or a new delivery date.
3. Order
Any order placed on the Website implies full acceptance of these GTC. The Customer must create an account or provide complete and accurate personal information. An order confirmation email is sent to the Customer summarizing the essential information of the purchase.
The company reserves the right to cancel an order in the following cases: an obvious pricing error displayed on the Website, suspicion of fraud or abusive ordering, permanent unavailability of the product. In such cases, the Customer will be informed as soon as possible and fully refunded.
4. Prices
The prices displayed on the Website are indicated in euros and include the VAT applicable in Belgium. Shipping costs are added to the total price of the order and are clearly indicated before the order is validated.
5. Payment
Orders are paid online using the following methods: Bancontact, Visa, Mastercard, PayPal and certain banking applications. The order is processed only after payment has been validated. CHC Co. guarantees secure transactions and does not record the Customer’s banking information at any time. The company may remove, replace or modify the payment methods available on the Website at any time.
6. Delivery
Delivery is made to the address provided by the Customer when placing the order. Delivery times are indicative and are specified at the time of ordering. Unless otherwise stated, delivery will take place within a maximum period of 30 days from the order confirmation. CHC Co. cannot be held responsible for delays caused by exceptional circumstances or by the carrier.
The risk of loss or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer, physically takes possession of the products.
If no one is able to accept the delivery at the time of delivery, a delivery notice will be left or notified via online tracking, and the Customer must contact the carrier to obtain the address where the parcel can be collected.
If the parcel is not collected by the Customer within the time limit granted by the carrier and is returned to us, CHC Co. may, at the Customer’s choice: (i) arrange a new shipment (reshipping costs may be charged to the Customer), or (ii) refund the order, minus the delivery, return and handling costs actually incurred by CHC Co.
7. Right of Withdrawal
In accordance with European legal provisions, the Customer has a period of 14 calendar days from the day after receipt of the products to exercise the right of withdrawal without having to justify reasons or pay penalties.
To exercise this right, the Customer may notify the decision to withdraw by any unambiguous statement: by using the “return” function available in the Customer account, by using the standard withdrawal form, or by contacting our customer service by email or mail. CHC Co. will acknowledge receipt of the withdrawal request.
After notifying the decision to withdraw, the Customer has 14 days to return the product(s). The Customer bears the return costs, except in the event of a defective product or an error on our part.
The Customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods. The returned product should be sent back, if possible, with all its accessories.
The refund will be made no later than 14 days from the notification of withdrawal. However, CHC Co. may withhold reimbursement until it has received the goods back or the Customer has supplied evidence of having sent back the goods, whichever is the earliest. In the event of withdrawal, CHC Co. reimburses the price of the returned product(s) as well as standard delivery costs. Additional costs related to a more expensive delivery method (e.g. express) are not reimbursed. The refund will be made using the same means of payment as used for the order, unless the Customer expressly agrees otherwise.
Exception to the right of withdrawal: In accordance with Article VI.53 of the Belgian Code of Economic Law, personalised products and all items made according to the Customer’s specific requests are excluded from the legal right of withdrawal and cannot be returned or exchanged.
8. Warranty and Conformity
All products benefit from the legal guarantee of conformity for a period of two years from delivery, as well as the guarantee against hidden defects. In the event of non-conformity or a defect, the Customer must contact CHC Co. to report the issue and obtain an appropriate solution (replacement, repair or refund).
9. Liability
CHC Co. declines any liability for damage resulting from improper use of the ordered products. CHC Co. prohibits the use of its accessories for children under 3 years of age. CHC Co.’s liability is limited to the amount of the order in the event of direct damage.
10. Personal Data
The Customer’s personal data are collected and processed in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR).
11. Intellectual Property and Brand Protection
The brand “Mr. Célestin” (“Monsieur Célestin”) is a registered trademark and is protected by intellectual property rights, registered with the European Union Intellectual Property Office (EUIPO) and the Benelux Office for Intellectual Property (BOIP). This protection extends to all distinctive elements of the brand, including, but not limited to, the logo, the name, the slogan and any graphic or textual element related to the brand.
Any reproduction, imitation, modification or exploitation of the trademark, even partially, without prior written authorization from CHC COMPANY SRL is strictly prohibited. This includes, in particular:
- Copying or using the logo and/or brand name on other products or services;
- Creating similar products or services intended to mislead customers into believing they originate from Mr. Célestin;
- Using the name or associated images in advertising materials or on websites without permission;
- Distributing and selling counterfeit products imitating those of the brand.
CHC COMPANY SRL will take legal action against any person or entity infringing its intellectual property rights.
Offenders may be held liable for damages covering losses incurred, as well as legal costs and damage to brand image. Any act of counterfeiting, copying or unauthorized exploitation exposes the perpetrators to civil and criminal sanctions in accordance with the laws in force in the European Union and the Benelux. Any infringement, whether intentional or negligent, will be pursued without exception to protect the integrity and value of the Mr. Célestin brand. The content of the Website (texts, images, logos, etc.) is protected by intellectual property law and remains the exclusive property of CHC Co. Any total or partial reproduction without authorization is prohibited.
12. Disputes and Applicable Law
These GTC are governed by Belgian law. In the event of a dispute, the Customer is invited to contact customer service to find an amicable solution. Failing agreement, the dispute will be submitted to the competent courts in accordance with the applicable rules.
